Timely and Cost-Effective Representation in Northeast Ohio

If you are considering filing for divorce, you may have basic questions about child support or alimony. How will the court determine the amount of child support? What if there are special needs? Under what circumstances will the court award alimony or spousal support?

If your divorce is final, but your circumstances have changed, you may also be uncertain about your rights. Can you request a change in child support or alimony? What are the criteria and what must you show?

At the law offices of James E. Brightbill, in Akron, we understand the anxiety that comes from not knowing what will happen and we work hard to make certain that you are regularly informed about the status of your case, your options going forward, and your likelihood of success. Contact our offices for a free 30 minute consultation.

In our practice, we focus on results, not on conflict. Our goal is always to resolve your legal problems as quickly and cost-effectively as possible. Though we are always prepared to take your case to trial, we will explore a negotiated settlement, if doing so is in your best interests.

We work with clients at all stages of a child support or alimony issue, from the determination of temporary orders of support when a divorce complaint is filed to post-judgment requests for modification or enforcement of a support order.

Child Support

In Ohio, child support is determined by applying a formula found in the state's child support guidelines. The formula is based on the respective incomes of the parents. We will make certain that you understand the guidelines, that the guidelines are properly applied, and that all income is fairly considered, including self-employment or seasonal income. If special circumstances indicate that child support should deviate from the guidelines, we will petition the court to increase or decrease the support as necessary.

Alimony

Though alimony is not automatically granted in Ohio, there are situations where the court will consider a grant of spousal support to be necessary. The court will consider a variety of factors in making this determination, including

  • The respective incomes and earning potential of the parties

  • The lifestyle to which the parties have become accustomed

  • The age and health of the parties

  • Whether there is a child support order in place

We will help you determine whether a grant of alimony is appropriate and, if so, the amount, frequency and duration of payments.

For timely and economical resolutions to your child support and alimony problems, contact us to set up a free 30 minute initial consultation.
