Chapter 7 Bankruptcy
In a Chapter 7 bankruptcy, also known as liquidation, you may fully discharge certain debts in exchange for the liquidation, or sale, of many of your assets. Most debts can be extinguished in a Chapter 7 filing, including credit card debt, personal loans, medical bills and past-due utilities. Certain debts, however, may not be discharged under a Chapter 7, including child support, student loans and many types of tax obligations. In addition, specific assets may be exempt from sale, such as a principal residence, your automobile and some of your personal belongings.
We will help you determine whether you qualify to file under Chapter 7, and if so, make certain your assets are protected and all dischargeable debts are included in the bankruptcy.
Chapter 13 Bankruptcy
In a Chapter 13 filing, you agree to restructure your debt, paying creditors over a period of three to five years. Customarily, you are able to keep all of your assets. If you pay the debt according to the repayment agreement, your debts will be discharged.
We will work closely with you throughout the Chapter 13 proceeding, reviewing any proposed repayment plans to make certain they are reasonable. If you make promises that you fail to keep, the bankruptcy can be terminated and your creditors can contact you directly.
